OK -- so got time to pick this up again -- everything seemed there in the correct order of assembly:

Also, before removing the axle I had turned the rear wheel -- it was not scraping all the way around -- it scraped for half a turn, was free for half a turn, and so on. To my eye, did not look like the disc was warped.
Is the disc the issue?

If the brake disc is only scraping in one area, one would assume the disc is warped or the wheel is not running true.
A few thoughts... there is a "collar" about three inches long that should be located inside the final drive which the axle inserts into (between the wheel and final drive). It can be easily misplaced...
It may have been mentioned before, but the proper procedure for installing/ tightening the wheel/ final drive should be followed to ensure correct alignment.

OK -- so did a quick fix. I placed a 7/8 diameter thin bushing on the inside of caliper bracket between that and the inner spacer that goes into the wheel. No more scraping
I do have new disc I will install in spring when I replace my tire and also my bearings.

Is the long spacer in place that slides into the final drive?
